By creating an account, accessing, or using Ascension (the "App", "Service", or "we"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not create an account or use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.
Ascension is a personal productivity and self-progression application that gamifies habits, tasks, and long-term goals. The Service is provided on a subscription and/or limited-trial basis as described within the App.
We may add, modify, or remove features at any time. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.
You are responsible for safeguarding the credentials used to access your account (including any Google or Apple identity used for sign-in) and for all activity that occurs under your account.
You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
Paid subscriptions are billed in advance on a recurring basis (for example, monthly or yearly) at the price and frequency shown at the point of purchase.
Subscriptions automatically renew unless canceled. You can manage or cancel your subscription at any time through your Apple App Store or Google Play account settings. Deleting the App does not cancel your subscription.
Except where required by law, payments are non-refundable. Refund requests for purchases made through the App Store or Google Play are handled under those platforms' respective policies.
The Service and all of its contents are owned by the Company and protected by copyright, trademark, trade-secret, and other intellectual-property laws. This includes, without limitation: the App's source code, software, and architecture; its visual design, user interface, layout, and animations; its name, logo, and branding; and all text, graphics, and audio.
It also expressly includes our proprietary structures, systems, and methods — including but not limited to our strategic progression frameworks, skill-tree and campaign systems, cyclical and streak-based tracking systems, raid and economy mechanics, scoring formulas, and the selection, arrangement, and presentation of these elements.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes. You may not copy, reproduce, reverse-engineer, decompile, adapt, republish, or create derivative works from any part of the Service, or use our proprietary frameworks or systems to build, train, or operate a competing product, except to the extent this restriction is prohibited by applicable law.
You agree not to misuse the Service. Prohibited conduct includes, without limitation: accessing the Service through automated means (bots, scrapers, crawlers, or scripts) without our express written permission; harvesting, scraping, or extracting data or content from the Service; circumventing, disabling, or interfering with security or access-control features; probing or testing the vulnerability of our systems; reselling or commercially exploiting the Service; or attempting to gain unauthorized access to any account, system, or data.
You also agree not to upload or transmit malware, abuse rate limits, impersonate others, or use the Service in any way that violates applicable law or infringes the rights of others.
We may suspend or terminate your account or access to the Service, in whole or in part, at any time and without prior notice or liability, if we reasonably believe you have violated these Terms, engaged in abuse or scraping, or created risk or legal exposure for us or other users.
You may stop using the Service and delete your account at any time from within the App (Settings → Delete Account). Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, and Limitation of Liability — will continue to apply.
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that data will never be lost. You are responsible for maintaining your own backups of important data where the App provides an export feature.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) US $100, OR (B) THE TOTAL AMOUNT YOU ACTUALLY PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the App. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the Company is established, without regard to conflict-of-law principles.
